Privacy Policy.

KartPace is a product brand of Digital Andrei Marketing LLC ("KartPace," "we," "us," or "our"). This Privacy Policy explains how we handle information in connection with the KartPace Timer mobile application, the KartPace website and product pages, and support communications (together, the "Services").

1. Privacy at a glance

KartPace Timer is designed to work offline and without an account.

• The current production design does not require an account, cloud synchronization, GPS, advertising, cross-app tracking, telemetry import, or a network connection for live timing.
• Driver names, kart numbers, track names, timing events, lap results, notes, presets, settings, and saved reports are stored locally in the App's private storage on your device unless you choose to export them.
• We do not receive or have access to your locally stored timing data merely because you use the App.
• If you join the launch waitlist on our website, we receive the email address and phone platform you enter and use them only to tell you when KartPace Timer is available. See Launch waitlist.
• We do not sell personal information, share it for cross-context behavioral advertising, or use it for targeted advertising.
• Apple processes App Store downloads and in-app purchases under Apple's own terms and privacy practices. We do not receive your full payment-card information.

2. Who is responsible for personal data

For personal data that we receive through the website, support communications, legal requests, or our business records, the controller or business is:

3. Information handled by the App on your device

The App may let you enter or create:

• driver names or nicknames;
• kart numbers and spotting notes;
• track names and session types;
• timing events, lap times, exclusions, predictions, corrections, pit events, and session statistics;
• saved reports and driver lineups or presets;
• App settings, accessibility preferences, tutorial progress, free-usage counters, and Pro-entitlement state; and
• draft or unfinished sessions used for crash recovery.

This information is processed locally on your device to provide timing, recovery, reports, exports, presets, and related App features. Under the current production architecture, it is not transmitted to KartPace servers.

Device backups

Your operating-system or Apple backup settings may include App data in device or cloud backups. Those backups are controlled by you and Apple, not by KartPace. Review your backup settings if you do not want App data included in a backup.

Development-only diagnostics

Internal development builds may contain local diagnostic tools used for testing timing latency, save reliability, recovery, interruptions, corrections, prediction performance, and eligible battery metrics. Those tools are designed to be absent from TestFlight and App Store production builds and not to include driver names, kart numbers, notes, or raw timestamps. The signed production build must be verified to exclude development-only diagnostics.

4. Information we may receive

Launch waitlist

KartPace Timer has not been released. If you join the launch waitlist on our website, we receive the email address you enter, the phone platform you select, which page you submitted from, and the date and time of the submission. Providing this information is optional and is not required to use any part of the Services.

We use a waitlist entry for one purpose: to email you about the launch of KartPace Timer and closely related availability updates. We do not use waitlist addresses for advertising, we do not sell or share them, and we do not add them to an unrelated marketing list. Every message we send includes a way to unsubscribe.

We keep waitlist entries until you ask us to remove yours, or until twelve months after launch, whichever comes first, after which we delete them. To be removed at any time, email contact@kartpace.com from the address you signed up with, or use the unsubscribe link in any message. For users in the EEA and the United Kingdom, our legal basis is your consent, which you may withdraw at any time.

Support and communications

If you contact us, we may receive your name, email address, message, attachments, device and operating-system details you choose to provide, purchase or transaction information you choose to send, and any other information included in your communication. Please do not send passwords, full payment-card numbers, health information, or unnecessary information about children.

Website and security logs

Website hosting, content-delivery, domain, and security providers may automatically process limited technical information such as IP address, browser or device type, requested page, referring page, date and time, and security or error information. We use this information to deliver, secure, troubleshoot, and maintain the website.

App Store purchases and platform information

Apple processes downloads, purchases, taxes, billing, refunds, and StoreKit transactions. We may receive purchase status, product identifiers, transaction identifiers, storefront or country information, sales reports, and aggregated App Store performance information. We do not receive your full payment-card number from Apple.

If you choose in your Apple settings to share device analytics with app developers, Apple may make certain crash or diagnostic reports available to us. Those reports are governed in part by Apple's settings and privacy practices.

Privacy and legal requests

If you submit a privacy request, complaint, or legal inquiry, we may receive contact information, information needed to verify the request, correspondence, and records of our response.

5. Information we do not intentionally collect through the current App

The current production design does not intentionally collect or transmit to us:

• precise or approximate location;
• contacts or address-book data;
• photos, videos, camera data, microphone recordings, or biometric data;
• health, fitness, motion, or medical data;
• advertising identifiers;
• browsing history across other apps or websites;
• cloud-stored driver or timing profiles;
• passwords or account credentials; or
• payment-card or bank-account details.

We do not use third-party advertising SDKs or tracking technologies in the current production design. This statement must be rechecked against the final signed binary and every included SDK before release.

6. How we use information we receive

We may use information we receive to:

• provide support and respond to questions;
• process or verify purchase and entitlement issues;
• operate, secure, troubleshoot, and improve the website and Services;
• investigate abuse, fraud, security incidents, or legal claims;
• comply with law, tax, accounting, court, or regulatory obligations;
• enforce our Terms of Use; and
• protect users, KartPace, Apple, track operators, and others.

We do not use support communications or website logs for targeted advertising.

7. Legal bases for users in the EEA, United Kingdom, and similar jurisdictions

Where applicable, we rely on:

• Contract: to provide requested support, deliver purchased features, and administer the Services;
• Legitimate interests: to secure and maintain the Services, prevent abuse, answer ordinary inquiries, and improve reliability, balanced against your rights;
• Legal obligation: to comply with tax, accounting, consumer-protection, privacy, law-enforcement, or court requirements; and
• Consent: when we specifically ask for it, including before any future non-essential analytics, marketing communications, or non-essential device storage where consent is required.

You may withdraw consent at any time for future processing. Withdrawal does not affect processing already lawfully completed.

8. When information may be disclosed

We may disclose personal data only as reasonably necessary to:

• Service providers: website hosting, content delivery, security, business email, customer support, legal, accounting, or similar providers acting for us;
• Apple: in connection with App Store distribution, purchases, refunds, fraud prevention, diagnostics, and platform requirements;
• Authorities and legal recipients: when required by law or reasonably necessary to protect rights, safety, and security;
• Business transactions: in a merger, financing, acquisition, reorganization, or sale, subject to appropriate safeguards; or
• At your direction: for example, when you export a report through the device share sheet.

We do not sell personal data or share it with data brokers or advertising networks. We require service providers to protect personal data consistently with their role and applicable law.

9. Exports and third-party destinations

KartPace Timer Pro may allow you to export text or CSV reports through the device share sheet. You choose the destination. Once information is sent to another app, person, cloud service, messaging service, email provider, or storage provider, that recipient's privacy and security practices apply. Review the export before sharing, especially when it contains a minor's name or performance information.

10. Cookies and similar technologies

The current KartPace website is intended to operate without advertising or behavioral-tracking cookies. We may use strictly necessary technical storage or similar technologies for security, routing, accessibility, or a feature you request.

Browser storage we currently use

If you join the launch waitlist, the website saves a small record in your browser's local storage noting that you signed up and the address you used. Its only purpose is to show you a confirmation instead of asking you again on a later visit. It stays on your device, is not a cookie, is not sent to us on subsequent visits, and is not used to identify or track you across sites. Clearing your browser's site data for kartpace.com removes it, after which the form simply appears again.

If we later add non-essential analytics, advertising, personalization, or similar technologies, we will provide any required notice and consent controls before activating them, honor applicable withdrawal choices, and update this Policy.

Do Not Track and Global Privacy Control

Because we do not currently track users across third-party services or sell or share personal information for behavioral advertising, browser Do Not Track and Global Privacy Control signals do not change the current operation of the Services. If our practices change in a way that triggers a legal opt-out obligation, we will honor applicable legally recognized signals and update this Policy.

11. Data retention

• App-local data: until you delete it using available App controls, reset the App, or uninstall the App, subject to device backups controlled by you and Apple;
• Launch waitlist entries: until you ask to be removed, or twelve months after KartPace Timer launches, whichever comes first;
• Support communications: normally for up to 24 months after the request is resolved, unless longer retention is reasonably needed;
• Website security logs: normally for up to 30 days, unless longer retention is needed to investigate abuse, security incidents, or legal requirements;
• Privacy-request records: normally for at least 24 months or as required by applicable law; and
• Tax, accounting, transaction, and legal records: for the period required by law, commonly up to seven years.

We may retain de-identified or aggregated information that can no longer reasonably identify an individual.

12. Deleting App data

Because the current App stores timing content locally and does not use an account or KartPace cloud, we cannot remotely view or delete that local content for you.

1. Delete individual reports, sessions, lineups, or presets using in-App controls.
2. Use Settings > Delete All App Data to remove App-local data.
3. Uninstall the App to remove its local container from the device.

A device or cloud backup may retain an older copy until you delete or overwrite that backup through your device settings.

13. Security

We use reasonable administrative, technical, and organizational safeguards appropriate to the limited information we receive. The App's local data is stored in the operating-system app sandbox and benefits from device and operating-system protections. Website and support providers should use encrypted transmission, access controls, logging, and appropriate contractual safeguards.

No storage or transmission method is completely secure. Keep your device locked and updated, protect exported files, and avoid entering unnecessary sensitive information.

14. International transfers

We are based in the United States. Information sent to us through support, the website, Apple reports, or legal requests may be processed in the United States and other countries where our providers operate. Where required, we rely on recognized transfer mechanisms, contractual safeguards, adequacy decisions, or applicable exceptions.

Before actively targeting users in the EEA or United Kingdom, we will confirm whether an EU or UK privacy representative is legally required or whether an exception applies.

15. Your privacy rights

Depending on where you live, you may have rights to:

• access or know the personal data we hold about you;
• correct inaccurate personal data;
• delete personal data;
• receive a portable copy of certain personal data;
• restrict or object to certain processing;
• withdraw consent;
• opt out of sale, sharing, targeted advertising, or certain profiling;
• appeal a refusal of a request where applicable; and
• complain to a privacy or data-protection authority.

To submit a request, email contact@kartpace.com with the subject Privacy Request - KartPace Timer. Describe the request and the jurisdiction in which you live. We may take reasonable steps to verify your identity and authority. We will not discriminate against you for exercising a legal privacy right.

These rights apply to information we control. Because we do not receive App-local timing data, requests sent to us cannot retrieve or erase data that exists only on your device.

California notice

We do not currently meet the known CCPA thresholds based on the product information reviewed, and we do not sell or share personal information for cross-context behavioral advertising. Even where the CCPA does not legally apply, we will make reasonable efforts to honor verified access, correction, and deletion requests for information we control.

For California online-privacy purposes, the categories we may collect through the website or support are identifiers and contact information, internet or network activity, customer-support content, purchase-support information, and inferences strictly necessary to resolve a request. The recipient categories are described in Section 8. We do not permit third parties to collect personal information through the Services for cross-site behavioral advertising.

EEA and UK complaints

Individuals in the EEA or United Kingdom may lodge a complaint with the data-protection authority where they live, work, or believe an infringement occurred. We encourage you to contact us first so we can try to resolve the issue.

16. Children and information about minor drivers

KartPace Timer is designed for parents, coaches, mechanics, and other trackside users. It is not directed to children under 13, and we do not knowingly collect personal information online directly from children under 13.

Karting drivers may be minors. An adult user may choose to enter a minor driver's name or nickname locally on the user's own device. We recommend using initials or a nickname, avoiding sensitive notes, and reviewing exports before sharing. The local entry does not cause KartPace to receive the information.

A person under the age of legal majority should use the Services only with permission and supervision from a parent or legal guardian. If you believe a child sent personal information to us through support, contact us so we can review and delete it where appropriate.

17. Changes to this Policy

We may update this Policy to reflect changes in the App, website, providers, law, or business practices. We will post the updated version with a new "Last updated" date. If a change materially affects how we handle information, we will provide additional notice when reasonably appropriate, such as an in-App notice or website banner.

No policy update will retroactively authorize materially different processing where applicable law requires new notice or consent.
